Terms of Service

1. Introduction & Acceptance of Terms

By accessing or using the LaserPecker South Africa website (the “Site”), and by placing an order or otherwise interacting with us, you (“you”, “customer”, “consumer”) agree to be bound by the following Terms of Service (the “Terms”). If you do not agree with these Terms, please do not use the Site or place any order.

We reserve the right to update these Terms from time to time. The updated version will be indicated by a revised “Last Updated” date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.


2. Definitions

  • “Supplier / We / Us / Our” — LaserPecker South Africa (the retailer and operator of the Site).

  • “Customer / You / Your” — any person who visits the Site, places an order, or otherwise uses our services.

  • “Goods / Products” — any items offered for sale on the Site, including laser engraving machines, accessories, spare parts, and related items.

  • “Order” — your purchase request accepted by us via the Site.

  • “Electronic Transaction” — a transaction concluded through the Site, in compliance with ECTA.


3. Validity of Electronic Contracts (ECTA Compliance)

Under the Electronic Communications and Transactions Act, electronic agreements concluded via the Site — such as by placing an order and clicking “I Agree / Place Order” — are legally binding. The formation of such contracts is recognised under ECTA as valid. Dentons+1

You agree that by completing the checkout process and submitting an order, you are entering into a contract with us under these Terms.


4. Orders, Payment & Pricing

4.1 Product Information & Pricing

We aim to ensure that all product descriptions and prices are accurate and up to date. However, errors or omissions may occur. If a product’s listed price is incorrect due to a typographical error or other mistake, we reserve the right to cancel the order and refund any payment made.

Under the CPA, consumers have the right to clear, accurate, and not misleading pricing and product descriptions — we commit to upholding these standards. The DTIC+1

4.2 Payment Methods

We accept payments via [insert accepted methods — e.g. major credit cards, EFT, Pay-on-Delivery, etc.]. By placing an order, you warrant that you are the owner of the payment method used and that all payment details are accurate.

4.3 Order Acceptance & Confirmation

Once you place an order, you will receive an order confirmation email. This does not signify acceptance of the order. Order acceptance happens when we ship the goods — at which point a binding contract is formed.

We reserve the right to refuse or cancel any order for any reason before shipping (e.g. stock unavailability, pricing errors, payment issues).


5. Delivery, Shipping & Risk

Refer to our separate Shipping Policy for full details. Key points:

  • We will deliver goods to the address you provide.

  • Risk in the goods passes to you upon dispatch.

  • Delivery time-estimates are indicative; external factors (courier delays, customs, force majeure) may affect actual delivery time.

  • If you fail to provide correct address or contact info, or refuse delivery without valid reason, you may incur additional costs or forfeiture of the order.

Under the CPA and ECTA, suppliers must deliver goods within a reasonable time (or within a period agreed on). For online transactions, 30 days is often considered reasonable unless otherwise agreed. SAFLII+1


6. Returns, Refunds & Warranty

In summary:

  • You may request refund/replacement for defective or unsafe goods under statutory implied warranty rights. CPA gives you rights for goods to be of good quality, safe and fit for purpose. Government of South Africa+1

  • For other returns (e.g. change of mind), we may accommodate at our discretion under the terms in our Returns & Refund Policy.

  • Warranty claims for defects after the statutory period will follow our separate Warranty Policy.


7. Use of the Website & Prohibited Conduct

When using the Site, you agree not to:

  • Use false, misleading, or fraudulent information when ordering or interacting with us.

  • Interfere with or abuse any portion of the Site, or access it in an unauthorised manner.

  • Transmit harmful code, viruses, or malicious content.

  • Violate any applicable laws or third-party rights (privacy, intellectual property, etc.).

We reserve the right to suspend or terminate your access and cancel orders if we suspect misuse or violation of these Terms.


8. Intellectual Property

All content on the Site — text, images, logos, trademarks, product descriptions, designs — is the property of LaserPecker South Africa or its licensors, unless otherwise stated. You may not copy, reproduce, distribute, or republish any such content without prior written consent.


9. Limitation of Liability & Disclaimers

  • To the extent permitted by law, we exclude liability for indirect, incidental, special or consequential damages (including loss of profits, loss of business, or data).

  • Our liability for any claim related to any goods or services is limited to the purchase price paid for those goods.

  • We make no warranty that the Site will be uninterrupted, error-free, or free of viruses.

Nothing in these Terms seeks to exclude your rights under applicable law (such as the CPA or ECTA) which cannot be waived.


10. Privacy, Data Protection & Cookies

By placing an order or submitting information, you consent to the collection and processing of your personal data in accordance with our Privacy Policy.


11. Direct Marketing & Communications

If you opt-in to receive marketing communications, we may send you newsletters, promotional offers or updates.

You may opt-out at any time. We will not send unsolicited marketing communications contrary to your preferences.

12. Governing Law & Dispute Resolution

These Terms and any transaction you enter into with us shall be governed by the laws of the Republic of South Africa.

For disputes, you agree to attempt informal resolution first by contacting us. If resolution fails, disputes may be referred to the appropriate courts or regulatory bodies in South Africa.
